950-2-2-.01 Statement Of Policy.

(1) A policy was adopted by the Youth Services Board on September 25, 1981, wherein admission to the Department will be on a priority basis.

(2) In order to comply with this policy, a four member committee was established. The committee is comprised of administrative and supervisory staff from the Diagnostic and Evaluation Center and the Institutional Services Division. The committee will consider each request for admission submitted, based upon the following criteria in rank order:

(a) Seriousness of offense

(b) Prior record

(c) Demeanor of the juvenile

(d) Where juvenile is being held

The reliability of the committee's actions is greatly affected by the thoroughness, completeness, and the accuracy of the written information submitted. Incomplete reports will remain pending until adequate information is submitted.

(3) Immediate priority will be given to Class A Felons and other person crimes to include, but not be limited to, the following:

(a) Murder

(b) Assault with intent to murder

(c) Manslaughter

(d) Rape or attempted rape (and other sex-related crimes)

(e) First degree arson

(f) Armed robbery

(4) High priority will be given to habitual offenders (three or more delinquency adjudications) as follows in rank order:

(a) Crimes against persons (felon)

(b) Property crimes (felon)

(c) Crimes against persons (misdemeanor)

(d) Property crimes (misdemeanor)

(e) Failure to respond to prior treatment efforts will also be considered.

(5) The demeanor of the child will be considered and priority established as appropriate in cases where the continued residence by the child poses a significant threat to the community. Documentation of incidents such as repeated escapes, commission of other crimes, or the safety of the child being threatened by the community will be required.

(6) Finally, priority will be given in cases where documentation shows no available detention space.

950-2-2-.03 Effective Date. This policy adopting an intake procedure on a priority basis shall be effective beginning November 1, 1981.
